PILOT International Warranty
PILOT International Warranty for Australians Customers
Introduction
This warranty (the “Warranty”) applies to designated products manufactured by Pilot Corporation (Japan) (“PILOT”) and imported and distributed in Australia by Pilot Pen Australia (“PPA”). PPA is the authorised Australian distributor of PILOT products.
Covered Products
Products manufactured by PILOT that are listed as covered products on the PILOT International Warranty website and in respect of which the owner possesses the PILOT Warranty Card included in the original packaging (the "Warranty Card"), hereinafter referred to as "the Covered Product(s)".
Your Rights
This Warranty does not limit, and is in addition to, any other rights or remedies provided by the laws of Australia (including the Australian Consumer Law), or your state of residence. In the event of any conflict or inconsistency between this Warranty and applicable laws, the provisions of the applicable laws shall prevail.
If any products manufactured by PILOT (including any Covered Products) were purchased by you in or from Australia, then our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Warranty Period
For this Warranty to apply, a manufacturing defect (hereinafter referred to as "Defect(s)") must have appeared within three (3) years from the date of the original (that is, not second-hand) purchase of the Covered Product (the "Warranty Period").
Warranty Coverage
In the event that you make a claim under this Warranty, and a defect is identified by PILOT or PPA in the Covered Product that arose during the Warranty Period, PPA will, at its sole discretion, repair or replace the defective product free of charge under this Warranty. You may have an election as to your remedy under the laws of Australia (including the Australian Consumer Law if applicable) or your state of residence, and nothing in this provision limits the operation of any such laws.
Warranty Conditions and How to Claim
- 1.Contact Information
If you identify any Defect(s) within the Warranty Period, please first contact either a) the store where the Covered Product was purchased, b) PPA at the email address at the end of this document, or c) your nearest customer service centre. - 2.Warranty Card and Return of Product
To claim under this Warranty, you must present the PILOT International Warranty Card (hereinafter referred to as "the Warranty Card”) provided at the time of purchase along with the Covered Product, which together must be returned to the store of purchase, PPA's physical address at the end of this document, or a customer service centre. The Warranty Card must include the required information such as the purchase store name of the Covered Product and purchase date. If the required information is not included, proof of purchase such as a receipt must be attached. - 3.Shipping and Associated Costs
Any shipping fees, customs duties, and other associated costs incurred when sending the defective product to the store of purchase, PPA, or a customer service centre shall be borne by the customer. It is recommended to use a tracked shipping and to include shipping insurance when sending the defective product.
Notes on Repairs and Replacements
- 1.If the main unit or any parts are replaced under this Warranty, the original unit or parts will become the property of PILOT and will not be returned to the customer.
- 2.If obtaining an identical part is difficult or for other reasons, PILOT or PPA may, at its sole discretion, replace it with an equivalent part.
- 3.Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.
Exceptions to Coverage
This Warranty does not apply to Defect(s) arising from the following circumstances:
- (1) Normal wear and tear, deterioration due to aging, or consumption under regular use.
- (2) Improper use, dropping, applying impact, or other issues caused by intentional or negligent actions of the customer.
- (3) Improper storage or environmental conditions such as exposure to chemicals or extreme temperature fluctuations.
- (4) Alterations, modifications, or adjustments performed by individuals other than the technicians of PILOT.
- (5) Use of non-genuine consumables such as ink or refills, not manufactured by PILOT.
- (6) Loss, theft, fire, or any other events arising from force majeure.
- (7) Failure to present the original Warranty Card with the required details. Altered or counterfeit the Warranty Card or the Warranty Card issued for other products will also be exceptions to coverage.
Limitation of Liability
Subject to any rights or remedies you may have that cannot be excluded under the laws of Australia or your state of residence:
- (1) PILOT and PPA’s liability for Defect(s) in the Covered Product under this Warranty is strictly limited to the scope of this Warranty, and all implied terms are excluded to the extent permitted by law. Except in cases of wilful misconduct or gross negligence by PILOT or PPA, PILOT or PPA shall not be liable under this Warranty for any damages, including but not limited to direct, indirect, incidental, consequential, or special damages, regardless of foreseeability.
- (2) PILOT and PPA reserve the right to change this Warranty at any time without prior notice to you. Any changes to this Warranty will be announced on the PILOT International Warranty website and will apply to purchases made after the change comes into effect.
